By means of this bail application the applicant has prayed to be enlarged on bail in DRI Case No. 07 of 2016 at Police Station D.R.I District Gorakhpur under Section 8/20 N.D.P.S Act, The applicant is in jail since 17.11.2016.

The bail application of the applicant was rejected by learned Additional Sessions Judge/ Special Judge (Prevention of Corruption Act), Gorakhpur on 24.12.2016.

Shri Krishna Agarwal, learned counsel for the N.C.B. contends that all the prosecution witnesses have been examined. The trial is at the stage of Section 313 Cr.P.C. However the trial is being impeded by one of the co-accused who was enlarged on bail and is now absconding. Clearly the said accused person wants to delay the trial.

No useful purpose will be served by granting bail to the applicant at this stage. The trial is near conclusion.

The bail application is rejected.

However the trial court is directed to expeditiously conclude the trial within a period of two months from the date of production of certified copy of this order and render its verdict within a stipulated period of time. The applicant is regularly attending the trial proceeding. The case of the applicant shall be separated from that of the said co-accused who has since been absconding. Thereafter the trial court concerned shall proceed on day to day basis without granting any unnecessary adjournments and render a judgment preferably within 3 months from the receipt of a copy of this order.
