Order on C.M.Application No. 01 of 2022 (Application for Condonation of Delay)
Ground shown in the affidavit filed in support of application for condonation of delay is sufficient.
Accordingly, application is allowed and delay in filing the revision is condoned.
Order on Revision
1. Heard learned counsel for the revisionist and learned A.G.A. for the State-respondent.
2. Present revision under section 19(4) of the Family Court Act, 1984 has been filed against the Judgment and Order dated 06-01-2020 passed by the learned Principal Judge, Family Court, Balrampur, in Crl. Misc. Case No.-M 189/2015, by which application filed by the wife of the revisionist under section 125 Cr.P.C. for granting maintenance has been allowed.
3. By the impugned order 06-01-2020, learned Principal Judge, Family Court, Balrampur after considering the evidence on record has awarded interim maintenance @ Rs. 3,500/- P.M. to the wife of the revisionist.
4. This court does not find any error of law or jurisdiction in the impugned order passed by the learned learned Principal Judge, Family Court, Balrampur in awarding meager amount of maintenance @ Rs. 3,500/- P.M. to the wife by the revisionist.
5. This revision is without merit, which is hereby dismissed.
