Sri Sanjay Kumar Srivastava, learned counsel for applicant, after arguing for some time, on instructions submits that applicant has already appeared in Case No. 2527 of 2020 (State vs. Manoj) arising out of Case Crime No. 360 of 2019 under Sections 306, 506 I.P.C., P.S. Ghanghata, District Sant Kabir Nagar, therefore, he may be permitted to file discharge application which may be decided in accordance with law taking note of judgment of Supreme Court in Ghulam Hassan Beigh vs. Mohammad Maqbool Magrey and others, 2022 SCC Online SC 913.

Considering above submissions made on instructions, prayers made in this application are rejected.

However, this application is disposed of with liberty to applicant, who has already been appeared, to file discharge application at appropriate stage and that same shall be considered in accordance with law taking note of Ghulam Hassan Beigh (supra).
