This criminal revision has been preferred against the judgment and order dated 23.09.2015 passed by the Prinicipal Judge, Family Court, Hathras in Case No.9 of 2013 (Smt. Rajani @ Pooja Tomar vs. Alok Raghav), by which application under Section 125 CrPC has been allowed ex parte and revisionist has been granted Rs.5000/- per month as maintenance allowance.
Perused the impugned order. There appears no illegality or material irregularity or manifest error in the impugned order. None to press the present revision. Matter is 7 years old. It appears that due to efflux of time, revisionist has lost interest in the matter and do not want to pursue the matter further.
In view of the above, this criminal revision is accordingly dismissed.
Revisionist is given option to file application for enhancement of maintenance under Section 127 CrPC.
