Ms. Arti Agarwal, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellants- Smt. Ram Beti and Kesari Singh @ Kesar Singh against the judgment and order dated 22.06.2000 passed by learned Sessions Judge, Mainpuri in Sessions Trial No. 251 of 1990, Police Station Bhogaon, District Mainpuri.

As per office report dated 05.11.2022 a report from C.J.M. concerned was called for regarding living status of the appellants in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 17.01.2022 informed that the appellants- Smt. Ram Beti and Kesari Singh @ Kesar Singh have died on 23.12.2009 and 25.04.2008 respectively. In support of which a report of concerned police station and the copy of death certificate issued by Government of Uttar Pradesh as well as village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
