In re: Civil Misc. Correction Application No. 3 of 2022
Instant correction application has been moved to correct the observation made by this Court in third paragraph of third page of the order dated 20.07.2022 by deleting phrase "got their name recorded in the revenue record".
There is no oppose by the counsel for the contesting respondent to the correction application.
Accordingly, third paragraph of third page of the order dated 20.07.2022 is corrected/modified to the following effect:-
The phrase "got their name recorded in the revenue record", as mentioned between the words "1954 and" and "vide order dated 19.04.2017", shall be read and understood as "name of contesting respondent was expunged and the land is recorded as Navin Parti".
The correction application is allowed accordingly.
While hearing the correction application, counsel for the petitioner has prayed to consider the dictum of Division Bench in the case of Anil Kumar Gupta and another vs. Subhash Chandra Agarwal and another, reported in 2018(139) RD 665.
In the aforesaid matter phrase "sufficient cause" has been discussed by the Division Bench of this Court after relying upon several judgments.
In light of the facts and circumstances of the present case, wherein respondent came to know about the order dated 07.09.1994 after the endorsement dated 19.04.2017 made by the Lekhpal in the Khatauni 1421 Fasli to 1426 Fasli, case cited, as above, is not applicable in the present matter.
