Heard learned counsel for the parties, learned A.G.A. for the State and perused the material on record of this appeal.
This appeal has been preferred by appellant- Gurusharan against the judgment and order of Additional Sessions Judge, Barabanki dated 13.1.2004 in S.T. No.268 of 1997, under Section 302/34 IPC, Police Station- Asandra, District Barabanki, convicting and sentencing the appellant under Section 302/34, 506 IPC for life imprisonment.
From perusal of the report of the Chief Judicial Magistrate, Barabanki dated 12.11.2021 which is on record of this appeal, it transpires that the sole appellant in this appeal- Gurusharan has died.
Learned A.G.A. has submitted that in view of the report of Chief Judicial Magistrate, Barabanki dated 12.11.2021, this appeal is liable to be abated.
In view of the submission made by learned A.G.A and on perusal of the recitals contained in report of Chief Judicial Magistrate, Barabanki, this appeal is dismissed as abated.
