Heard Guarav Srivastava, learned counsel for the petitioner and Sri Manoj Kumar Srivastava, learned counsel appearing for respondents.

By means of this petition filed under Article 226 of the Constitution, the petitioner has prayed for a writ of mandamus commanding the respondents to pay salary of pension and other retiral dues to the petitioner taking into account his past services rendered as a daily wager as he has been regularised in the establishment in the year 2015. He has placed reliance upon the judgment of the Supreme Court in the case of Prem Singh vs. State of Uttar Pradesh & others 2019 (10) SCC 516 which has been followed by a Co-ordinate Bench of this Court in Writ A No.17042 of 2021.

Learned counsel for the petitioner submits that he has retired from the establishment on 31.08.2021.

Learned counsel appearing for respondent does not have any objection in the event the petition is disposed of with direction to the competent respondent to consider the claim of the petitioner strictly in accordance with law in a time bound period.

It is therefore, directed that the petitioner shall make a representation ventilating his grievance along with the certified copy of this order within a period of three weeks from today before respondent concerned and upon receiving such application, the respondent authority shall take appropriate decision in this regard within a further period of three months from the date of receipt of such application along with the certified copy of this order.
