1. Heard learned counsel for the petitioner and learned A.G.A. for the State.
2. Report of the Mediation and Conciliation Centre is on record and according to that a settlement was arrived at between the parties, copy of which is on record, however, when the matter has been taken up today, respondent no. 2 Smt. Shikha Singh has submitted that after the agreement she has been deserted by the petitioner and she is presently residing with her parents. She has further stated that she has not been allowed to go into her matrimonial home.
3. In view of the above, the Court proceeds to decide the matter on merits.
4. Under challenge is the order dated 06.07.2017 passed by the Principal Judge, Family Court, Bahraich, by an ex-parte order, the application under Section 125 Cr.P.C. filed by respondent no. 2 has been allowed and petitioner has been directed to pay Rs. 6000/- per month as maintenance.
5. Perused the record available on the file, so also the impugned order dated 06.07.2017. It is not in dispute that respondent no. 2 is the legally wedded wife of the petitioner. She is residing away from the petitioner for sufficient reasons. She is house wife, destitute and incapable of maintaining herself whereas the petitioner is a salary person. The evidence led on behalf of respondent no. 2 in form of PW-1, PW-2 and PW-3 regarding income of the petitioner has not been rebutted by the petitioner before the learned trial court and in the judgment of the trial court it has come that the petitioner is a Drafts Man and makes jewellery and he earns Rs. 40,000/- per month. 6. On due consideration to the arguments advanced and perusal of the record, I do not find any illegality or error in the order impugned. The petition lacks merits and is accordingly dismissed.
