Heard Sri Atul Kumar, learned counsel for the applicant, learned AGA for the State and perused the material brought on record.

Sri Atul Kumar, learned counsel for the applicant positively asserted that applicant Aman is barely aged about 16 years of age as mentioned in paragraph 15 of the affidavit accompanying the bail application. The age of the victim is six years and relying upon the judgment of this court in the case of Radhika and others vs. State of U.P. and others in Crl. Appeal No. 4418 of 2019 decided on 05.08.2019. I do not find that the present bail application is maintainable and accordingly the present bail application is accordingly dismissed.

If so desired, the applicant may seek proper bail application pursuant to the to the Section 12 of the Juvenile Justice Act before Juvenile Justice Board, if the said application is moved, the same shall be decided within a week on merit.

With this observation, the present bail application is disposed of.
