Heard Sri V.K. Jaiswal, learned counsel for the appellant-applicant, Sri Bhanu Prakash Singh, learned Brief Holder and Sri S.C. Dwivedi, learned A.G.A. for the State and perused the material brought on record.
Obviously, the prayer has been made for recalling the judgment and order dated 29.01.2020 passed by us in the present appeal which was heard on 23.01.2020 and reserved for delivery of judgment on 29.01.2020 wherein the entire merits of the case has been touched and arguments heard on behalf of the appellant through amicus curiae, Sri Sukhvir Singh who was earlier appointed to represent the appellant.
Now it being full-fledged judgment on merits, the claim of the appellant that he wished to be heard through his counsel alone is, under circumstances, untenable. The entire claim of re-hearing is without any basis and more particularly barred by virtue of Section 362 Cr.P.C.
Consequently, the instant recall application is misconceived and is dismissed as such.
