Heard learned counsel for the petitioners and learned Standing Counsel for the respondents..

Controversy raised in the present petition has already been adjudicated by this Court in a bunch of writ petitions with leading Writ Petition No.17436 of 2014 (Harihar Singh and 6 others Vs. State of U.P. and 2 others), decided on 2.4.2014, which has also been followed in Writ Petition No.1200 of 2017 (Jitendra Singh Vs. State of U.P. and 3 others). This Court has observed that petitioners, who are firearm licensee, shall not be compelled to deposit their firearms unless their cases have been objectively reviewed by the competent authority in writing and after complying with the provisions of law.

Petitioners in the present case also contend that without passing any order they are being compelled to surrender his firearm licence.

Learned Standing Counsel appearing for the State, does not dispute the legal proposition laid down by this Court in the case of Harihar Singh (supra).

For the detailed reasons contained in the judgment dated 2.4.2014 in the case of Harihar Singh (supra), this writ petition is also disposed of on the same terms.

Order Date :- 22.6.2021
