Order on Delay Condonation Application

There is a delay of 8 days. An application to condone the delay has been filed.

Counsel for the respondents has no objection if the delay is condoned.

In view of the above, the application is allowed and delay is condoned.

Order on Appeal

By this appeal, a challenge is made to the judgment dated 12.09.2005 whereby the writ petition preferred by the appellant/petitioner was dismissed.

The writ petition was filed to challenge the order dated 26.05.2003 by which the appellant/petitioner was discontinued as Anganbadi Karyakarta.

It is stated that pursuant to the interim order passed before dismissal of the writ petition, the appellant is still working as Anganbadi Karyakarta. If that is so, then the appeal has become infructuous. The writ petition was preferred on discontinuance of the appellant/petitioner as Anganbadi Karyakarta.

Since as per the statement made by the appellant, she is continuing in service, the present appeal is disposed of, however, with the clarification that the continuance of the appellant would not be affected by the outcome of the judgment under challenge, if she is continuing.
