After arguing the matter at some length, learned counsel for the appellant submits that four teachers were transferred from Acharya Dwivedi Inter College, Raebareli to R.M.P. Inter College, Sitapur for the reason that no student remains in the school at Raebareli. The appellant has not joined the school at Sitapur while three others have joined. On instruction, he submits that even the appellant would join the school at Sitapur within a week.

Learned counsel for the respondents have no objection to it. The only prayer is to dismiss the appeal in the light of the aforesaid because liberty to join the school at Sitapur was given.

In the light of the statement made by both the parties and agreement thereupon, this appeal is disposed of without causing interference in the judgment of learned Single Judge but with a direction to allow the appellant to join the school at Sitapur, if he reports within a week. It is clarified that if the appellant defaults in joining the school at Sitapur within a week then even right to join the school may not survive. However, if the appellant join the school within a week, joining would be accepted by the respondents. The intervening period would be given consideration by the respondents properly for which we are keeping this matter open.

With the aforesaid, the appeal is disposed of.
