Heard learned A.G.A. and also perused the record.

This criminal appeal has been filed against the judgment and order dated 12.12.2001 passed by the Additional Sessions Judge (court no.8), Fatehpur in S.T. No.156 of 1998 under Section 307/34 IPC Police Station Hussainganj, District Fatehpur.

From perusal of the report of Chief Judicial Magistrate, Fatehpur dated 15.06.2021, it transpires that both the accused appellants- Jitendra Kumar alias Kalebaz and Sarvan Kumar, have died.

In view of the above stated fact that both the accused-appellants have since expired during the course of the pendency of this appeal, this criminal appeal stands abated.

Consequently, this criminal appeal is dismissed as abated on account the death of the both accused-appellants.

The present criminal appeal is accordingly, dismissed.
