Perused the material brought on record.

By way of instant appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 19.5.1989 passed by Additional Sessions Judge/Special Judge (E.C.Act),Budaun in Sessions Trial No.303 of 1986, under Section- 302 I.P.C., Police Station- Dhanari, District- Budaun whereby the appellants have been sentenced to undergo imprisonment for life.

From perusal of the reports of Chief Judicial Magistrate, Sambhal at Chandausi dated 25.6.2018, it transpires that appellants, namely Zarif Khan, Yameen and Islam have died 12, 13 and 14 years ago, respectively.

In view of above, this appeal is liable to be dismissed as abated.

The present appeal is, accordingly, dismissed.
