The petitioners have preferred the present writ petition, inter alia, with the prayer to quash the impugned order dated 17.02.2020 passed by the respondent no.1 and impugned notice dated 25.06.2020 issued by the respondent no.5, as well as, impugned enquiry report dated 28.01.2020 which is submitted by the Equiry Committee by the letter dated 29.01.2020. A further prayer has been made to issue a mandamus commanding the respondents not to interfere in peaceful functioning of the petitioners' Committee of Management as well as Teachers appointed in the institution.

Learned counsel for the petitioners relied upon the judgment delivered by Co-ordinate Bench of this Court dated 14.10.2020 in bunch of cases bearing leading Writ - A No.5540 of 2020 (C/M Sri Durga Ji Purva Madhyamik Balika Jamin and another Vs. State of U.P. and 4 others).

Heard learned counsel for the petitioners and learned Standing Counsel on behalf of respondent nos.1 to 3.

It is admitted that controversy involved in the present writ petition is squarely covered by judgment delivered by Co-ordinate Bench of this Court in the case of C/M Sri Sri Durga Ji Purva Madhyamik Balika Jamin (supra).

In view of the same, the writ petition is also allowed in terms of judgment and order passed in C/M Sri Sri Durga Ji Purva Madhyamik Balika Jamin (supra).
