Heard learned counsel for the petitioner and the learned Standing Counsel for the State respondents.
Petitioner who is an Assistant Teacher in a primary educational institution is aggrieved by the order of 16 September 2020 whereby he has been placed as Booth Level Officer by the respondents for undertaking a revision of the electoral list of the allotted polling station in September 2020. Undisputedly, no such work is being assigned or taken from him presently since the elections which were contemplated have since concluded.
While in that sense, this petition is rendered infructuous, the Court only observes that the respondents 2 to 4 shall ensure that the petitioner is not assigned election related duties bearing in mind the judgment rendered by the Division Bench of the Court in Sunita Sharma Advocate High Court & Another Vs. State of U.P. & 3 Others, [Public Interest Litigation (PIL) No. 11028 of 2015, decided on 8 August 2016].
Petition stands disposed of.
