The present contempt petition has been filed alleging non-compliance of the judgment and order dated 05.09.2019 passed in Writ Petition No.24157 (M/S) of 2019 whereby the respondent no.2 -Chairman, District Level Committee was directed to consider and decide the application of the petitioner.
In the compliance affidavit filed by the respondent -contemnor an order dated 16.10.2019 has also been annexed as Annexure 1, per which the application of the petitioner has been decided.
Learned counsel for the petitioner contends that the said decision is not in accordance with the provisions of the Scheme.
Be that as it may, the matter remains that the application of the petitioner has already been decided vide order dated 16.10.2019. In case the petitioner is aggrieved by the said order, it is always open for him to challenge the said order before the appropriate court in appropriate proceedings.
Consequently, the contempt petition is dismissed. Notices are discharged. However, the petitioner would be at liberty to challenge the order dated 16.10.2019 before appropriate court in appropriate proceedings in case he is aggrieved by the same.
