The present writ petition has been filed praying for a writ of mandamus commanding the respondents to treat the petitioner of being governed by the Old Pension Scheme as he has been selected prior to 1.4.2005.

It has been stated that the controversy involved in the present writ petition is covered by judgement dated 19.12.2019 passed by this Court in Writ-A No.55606 of 2008 (Mahesh Narayan & Ors. v. State of U.P. & Ors.).

The claim of the petitioner regarding applicability of the aforesaid judgment of the Court depends on verification of certain facts which can be done by the Director of Education, Secondary-Uttar Pradesh, Lucknow.

Accordingly, this writ petition is finally disposed of with a direction to respondent no.2 [Director of Education, Secondary U.P., Lucknow] to consider the claim of the petitioner in the light of the judgment and order passed on 19.12.2019 in Writ-A No.55606 of 2008 [Mahesh Narayan and others v. State of U.P. and others] and to pass an appropriate, reasoned and speaking order within a period of six weeks from the date of production of a copy of this order.
