C.M. Application No.74612 of 2020 - (Review Application)

Heard learned counsel for the review- petitioner and the learned counsel for the respondents.

This is a petition for review of the judgment and order dated 02.11.2020.

Hon'ble Supreme Court in the cases reported in (1995) 1 S.C.C. 170, Meera Bhanja (Smt.) vs. Nirmala Kumari Choudhary (Smt.) and (1997) 8 S.C.C. 715, Parsion Devi and others Vs. Sumitri Devi and others has held that the scope of review under Order 47 Rule 1 C.P.C. is very limited and this jurisdiction can be invoked only, if there is mistake or error apparent on the face of record.

The scope of an application for review is much more restricted than that of an appeal. Under the provisions to Order 47 Rule 1 of Code of Civil Procedure, 1908, the court of review has only a limited jurisdiction circumscribed by the definitive limits fixed by the language used therein.

Review is based on three specified grounds, namely, (i) discovery of new and important matter or evidence which, after the exercise of due diligence, was not within the applicant's knowledge or could not be produced by him at the time when the order was passed, (ii) mistake or error apparent on the face of the record, and (iii)for any other sufficient reason.

In the instant case, there is no error apparent on the face of record of the judgment. No case for interference is made out in the matter.

The review petition is accordingly dismissed.

Order Date :- 2.2.2021
