This appeal by the State has been filed challenging the judgment of acquittal dated 10.12.1983, passed by IInd Addl. District & Sessions Judge, Barabanki, in S.T. No.81 of 1984, under Section 396 I.P.C., Police Station Loni Katra, District Barabanki.

We have perused the report dated 07.11.2020 submitted by the Chief Judicial Magistrate, Barabanki whereby it has been informed that the sole respondent in this appeal, namely, Gur Bux S/o Suraj Bali has died on 12.06.2019.

In support of the said report, learned Chief Judicial Magistrate has enclosed the report of the Sub-Inspector, Police Station Loni Katra, Barabanki, death certificate dated 04.11.2020 issued by the Village Pradhan of the Gram Panchayat concerned, statement of Sub-Inspector of the police station concerned, statement of the Village Pradhan of the Gram Panchayat concerned and the statements of Ramsagar and Devdat Singh, who are the nephew of the respondent- Gur Bux.

In view of the aforesaid, this appeal is dismissed as abated.
