CMA No.95763 of 2021 - Application for correction

1. Heard Sri L.P. Misra, learned counsel for the applicant and learned ACSC for respondent - State.

2. This is an application seeking modification / correction in the order dated 19.07.2021.

3. After consideration of totality of material on record, facts of the case as well as consideration made by division bench of this Court as well as judgment passed in S.L.P. by Hon'ble Supreme Court, the claim for grant of notional promotion w.e.f. 18.11.1995 to 05.05.1997 was considered and direction was issued to the respondents for consideration.

4. By means of present application, it has been sought that the words "with all consequential benefits" be added in paragraph-24 of the aforesaid order, so that the applicant / petitioner may get the benefit as directed by this Court.

5. I have considered the submission advanced by learned counsel for the parties.

6. The claim of notional promotion of the applicant / petitioner was considered by this Court as well as by Hon'ble Supreme Court and upon examination and going through the rules promulgated, the direction was issued by this Court.

7. There is full fledged consideration of claim of the applicant / petitioner by Hon'ble Supreme Court as well as by this Court also, therefore, the modification / correction sought is not required to be incorporated in the order.

8. Accordingly, the application is disposed of.
