In pursuance of earlier order passed by this Court, Sri Mayanker Singh has produced this Court a copy of the instruction dated 10.08.2021 send by Director Secondary Education, U.P. Lucknow. The representation of the petitioner has been decided and a copy of the order passed on representation on 10.08.2021 has been enclosed in the instruction.
A copy of such decision dated 10.08.2021 has already been given to the learned counsel for the petitioner. Learned counsel for the petitioner has stated that despite observation of the Court, in favour of the petitioner, representation of the petitioner has been rejected.
This Court is sitting in contempt jurisdiction and having a very limited power of seeing whether order of writ court has been complied with or not. Since the order of writ court only directed that the petitioner may make a fresh representation alongwith copy of the judgment relied upon him and that the respondent no.2,after considering the same,should pass appropriate reasoned and speaking order thereon, this Court cannot adjudicate whether the petitioner's representation has been rightly and wrongly rejected.
The instruction produced before this Court, is taken on record.
The contempt petition is dismissed as having become infructuous giving liberty to the petitioner to challenge the order dated 10.08.2021 in appropriate forum, if he so advised.
