Heard the learned counsel for the parties and perused the record
This writ petition has been filed, inter alia, for the following relief:
"Issue a writ, order in the nature of mandamus directing the respondent no. 2 consider and decide the representation 5/3/19 moved by the petitioner in pursuance of the first information report dated 25/11/18 lodged by the petitioner being case crime no. 1017/18 under section 420/467/468/471/409/20-B I.P.C. P.S. Etmaddulla District Agra."
At the very outset, learned Standing counsel submitted that against the impugned order, the petitioner has an alternative remedy to file an appeal before the Commissioner but instead of availing the said remedy he has chosen to file the present writ petition, which is not maintainable.
We find substance in the submission so made by the learned Standing Counsel.
In view of the above, we do not see any justification to interfere in the matter. The writ petition is accordingly dismissed on the ground of alternative remedy.
