Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The submission of the learned counsel for the petitioner is that petitioner has been implicated in the case crime no. 71 of 2019 under sections 147, 148, 149, 323, 506, 452, 352, 188 I.P.C., section 7 Criminal Law Amendment Act and section 127 of Representation of the People Act, 1950 P.S. Mehnagar, district Azamgarh. As yet no final verdict has come against the petitioner. It is well settled law that on account of implication in criminal case, licence of the petitioner cannot be suspended.
Matter requires consideration.
Learned Standing Counsel has accepted notice on behalf of all the respondents. He prays for and is granted four weeks' time to file counter affidavit.
Two weeks thereafter to the petitioner to file rejoinder affidavit.
List this petition on 22.7.2019.
Till the next date of listing the effect and operation of the impugned order dated 30.4.2019 passed by the respondent no.2, District Magistrate/ Licensing Authority, District Azamgarh shall remain stayed against the petitioner.
