Sri Amit Tripathi, learned counsel for the appellants is present.

Vide order dated 12.3.2019 non bailable warrant was issued against the appellant no. 2 Brij Lal and death report with regard to appellant no. 1 Chhotey Lal and appellant no. 3 Amrit Lal was called for from C.J.M. concerned. In compliance thereof the C.J.M. has sent his report dated 16.4.2019 that appellant Chhotey Lal has died about 5 years ago and appellant no. 3 Amrit Lal has died about 10 years ago and appellant no. 2 Brij Lal is living at village Girdharpur, P.S. Manda, District Allahabad. His warrant has been sent to police station concern but there is no report of C.J.M. concern with regard to arrest of the appellant no. 2 Brij Lal.

Sri Amit Tripathi, learned counsel for the appellants states that appellant no. 2 Brij Lal has been arrested on 22.4.2019. He has also filed bail application on behalf of appellant Brij Lal.

Since the appellant no. 1 Chhotey Lal and appellant no. 3 Amrit Lal have died, therefore, the appeal for appellant no. 1 Chhotey Lal and appellant no. 3 Amrit Lal is abated. With regard to appellant no. 2 Brij Lal the compliance report is awaited.

List in the next cause list along with compliance report of C.J.M. concerned. In the meantime, learned A.G.A. may also seen instruction in the matter.
