Heard learned counsel for the parties.
In compliance of order dated 28.02.2019, the learned Additional Chief Standing Counsel has submitted that he has received complete instructions in the matter and he may be permitted to file the counter affidavit, for which, atleast two weeks time may be granted.
Let counter affidavit be filed within a period of two weeks. Rejoinder affidavit, if any, may be filed within a week thereafter.
List this petition in the week commencing 01.04.2019 as fresh.
Since learned counsel for the petitioner has submitted that identically placed persons are getting pension and their entire services have been counted for the purpose of making pension but the entire services of the petitioner has not been counted for the purpose of making pension, however, for making payment of gratuity and other benefits his entire services have been counted.
Be that as it may, if the similarly placed persons are getting pension, as an interim measure, it is provided that the petitioner should be paid atleast provisional pension and the order to this effect shall be passed by the opposite parties within a period of three weeks from today.
