Sri Arun Kumar, learned counsel filed Parcha on behalf of O.P. No. 2, is taken on record.
Heard learned counsel for the applicants, learned counsel for the O.P. No. 2 as well as learned A.G.A. for the State and perused the record.
The present 482 Cr.P.C. application has been filed by the learned counsel for the applicant to quash the impugned charge-sheet dated 27.3.2018 as well as its cognizance order dated 5.9.2018 in Case No. Nil of 2018, State Vs. Smt. Guddi, arising out of Case Crime No. 0265 of 2018, under section 138(1)(b) Indian Electricity Act, P.S. Kotwali Orai, District Jalaun.
Argument is that the applicant is willing to deposit the compounding fee and get the offence compounded.
Learned counsel for the opposite party No.2 does not disputes above the contention.
This application is disposed of directing the applicant to deposit compounding fee within the period of one month and the court below shall pass appropriate order on the compounding application within the period of two months thereafter.
In case of failure of applicant to deposit the compoundable fee, the court below shall proceed with the case in accordance with law.
