As per report obtained from the Post Office, respondent Nos. 1/1 to 1/3 have been duly served. S/Sri Pramod Bharadwaj and V.K. Upadhyay have also entered appearance on their behalf. Respondent Nos. 2 & 3 are stated to be proforma parties, therefore, service upon the said respondents is dispensed with.
An application seeking impleadment of U.P. Central Board of Waqf, as respondent No. 4 has been filed by the petitioner-tenant.
Indisputably, the U.P. Central Board of Waqf, Lucknow, whose impleadment is being sought was not party to the proceedings before the Courts below.
The instant petition has been filed challenging the order passed in Appeal No. 18/2008, in which also U.P. Central Board of Waqf was not a party.
Consequently, Civil Misc. Impleadment Application No. 381106 of 2014 is wholly misconceived and is accordingly rejected.
Sri Iqbal Ahmad, learned counsel for the petitioner states that he is not fully prepared with the matter and therefore, he prays that the petition be adjourned for next week.
