Heard learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondent nos.1 and 2. Mr. A. K. Yadav, learned counsel, has accepted notice on behalf of respondent no.3.
The petitioner has challenged the order dated 21.4.2012 passed by the respondent no.3/District Basic Education Officer, Allahabad, on the ground that the petitioner was not provided any opportunity to explain as to why his name was not send in the list of the teachers provided by the Management for grant in aid. Since the order passed by this Court in Writ A No.34860 of 2007 (Akbar Ali Vs. State of U.P. and others) decided on 29.2.2012 was not complied with hence the petitioner preferred the Contempt Application No.3630 of 2012 (Akbar Ali Vs. Sri Basu Dev Yadav) decided on 2.1.2019 and immediately thereafter, the petitioner has filed the present writ petition.
The matter requires consideration.
Issue notice to respondent no.4 returnable at an early date. Steps be taken within a week.
Counter affidavit be filed by all the respondents within six weeks. Rejoinder affidavit may be filed within two weeks' thereafter.
List immediately thereafter for admission/final disposal.
