Heard Sri Anilesh Tewari, learned counsel for the petitioner.
Notices on behalf of opposite parties have been accepted by the office of the learned Chief Standing Counsel.
By means of this writ petition, the petitioner has assailed the suspension order dated 11.01.2019 passed by the opposite party No.1.
The submission of learned counsel for the petitioner is that the suspension order has been passed with the allegation on which the petitioner may not be held to be responsible. He has further submitted that the allegations are not such wherein any major punishment may be provided to the petitioner if the charges are proved. He has also submitted that more than one month period have lapsed from the date of issuance of impugned suspension order, but no charge-sheet has been provided to the petitioner. Therefore, learned counsel for the petitioner has submitted that the impugned suspension order may be kept in abeyance and the departmental enquiry may be permitted to be continued and, the petitioner shall co-operate with the departmental proceedings.
List this petition on 01.03.2019 as fresh to enable the learned Additional Chief Standing Counsel to seek complete instructions in the matter.
