Order on Crl. Misc.Recall Application No.7 of 2019

Heard Sri G.S.Hajela, learned counsel for the appellants and Sri G.P.Singh, learned AGA for the State.

This is the second recall application filed on behalf of the appellants for recalling the order dated 14.12.2018. The first recall application moved on behalf of the appellants was rejected by this Court vide order dated 13.3.2019.

The grounds shown in the affidavit filed in support of the recall application for recalling the order dated 14.12.2018 by which non-bailable warrants were issued against the appellants no.2,3,4,5,7,9, 11 & 12 is hereby recalled.

Learned counsel for the appellants undertakes to argue the appeal when the matter is next listed and he states that the paper book has not yet been prepared.

O.S.D. (Criminal) is directed to ensure that the paper book is prepared within a period of six weeks from today on priority basis as the case is of the year 1990.

List the matter after six weeks for final hearing before the appropriate Bench.

Accordingly, the recall application stands disposed of.
