Heard learned counsel for the parties.

The petitioner has challenged the order dated 1.4.2010 (annexure 5 to the writ petition) passed by the respondent no.2/Executive Engineer, Irrigation Division, Ist Banda now Chitrakoot.

Learned counsel for the petitioner contended that by the aforesaid order certain benefits of promotional pay scale for which the petitioner was entitled was not paid to him. Learned counsel for the petitioner relied upon a Government Order dated 3.9.2001, which is appended as annexure no.1 to the writ petition. He further contended that various persons junior to the petitioner was provided the benefit of promotional pay scale but wholly illegally the said benefit was not provided to the petitioner.

With the consent of learned counsel for the parties, the writ petition is being disposed finally.

In the facts and circumstances, the petitioner is directed to make a fresh representation ventillating all his grievances before the respondent no. 2/Executive Engineer, Irrigation Division, Ist Banda now Chitrakoot along-with certified copy of this order as well as government order, which is relied upon by the petitioner, within a period of two weeks from today. If such a representation is made, the respondent no.2/Executive Engineer, Irrigation Division, Ist Banda now Chitrakoot, is directed to pass appropriate order in accordance with law within a further period of three months.

With the aforesaid observations, present writ petition is disposed of finally.

It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
