Heard Sri Vaibhav Srivastava, learned counsel for the petitioners.
Notices on behalf of opposite party Nos.1 and 2 have been accepted by the office of the learned Chief Standing Counsel, while Sri Sudhanshu Singh Chauhan, learned counsel has accepted notice on behalf of opposite party No.3, who has put in appearance on his behalf.
By means of this writ petition, the petitioner who is an employee of Co-operative Society, has prayed the benefit of fitment/ regularization and other service benefits.
Sri Sudhanshu Singh Chauhan,learned counsel for the opposite party No.3, has placed reliance upon the judgment of Hon'ble Apex Court in re: General Manager, Kisan Sahkari Chini Mills Ltd. Sultanpur, U.P. vs. Satrughan Nishad and others reported in (2003) 8 SCC 639 submitting that the writ petition is not maintainable in the light of the aforesaid dictum of Hon'ble Apex Court.
Sri Chauhan prays for and is granted two weeks' time to file the counter affidavit including the objection regarding maintainability of the writ petition. Rejoinder affidavit, if any, may be filed within a week thereafter.
