The petitioner had earlier filed writ petition no. 18651 of 2018. The High Court refused to entertain and interfere Under Article 226 of the Constitution of India as the matter was subject to arbitration. It was also observed in the said judgment that in the event the petitioner is aggrieved he can approach the second respondent for any interim order in case so desirable.
In the wake of the said observations having been made and the writ petition having been finally disposed of a second prayer for preventing the respondents not to take any coercive steps would not be entertainable as the relief prayed for in the present writ petition is nothing else but in effect seeking the same relief which had been sought earlier. We are therefore not inclined to entertain this petition without prejudice to the rights of the petitioner to approach the Collector for appropriate orders in terms of the judgment dated 23.5.2018. The District Magistrate shall be at liberty to pass appropriate orders within a month.
Disposed off with the aforesaid observation.
