By order dated 23.2.2018 in Public Interest Litigation (PIL) No. 2969 of 2018, this Court directed Tehsildar, Tehsil Sadar, district Jaunpur, opposite party herein to enquire into the allegation of illegal encroachment over Gaon Sabha land and take appropriate action in accordance with law, within a period of two months from the date of receipt of certified copy of the order.

Sri P.K. Giri, learned Additional Chief Standing Counsel, on instructions from the opposite party, states that an eviction order was passed against the persons found in illegal possession over public land on 23.11.2013. Thereafter, a recall application was filed, which too has been rejected on 23.5.2018. It further states that an appeal/revision is pending against the said order before the Collector and as soon as the same is decided and based on its outcome, the eviction order would be executed.

Having regard to the above position, this Court is not inclined to proceed any further in the instant matter. The contempt application is consigned to record.
