The counsel for the applicant submits that in the impugned F.I.R. registered as Case Crime No.122 of 2017 under Sections 307, 504, 506, IPC and 30 Arms Act, P.S. Marka, district Banda initially three persons namely, Narodaya Singh, Vijay Singh and Malkhan Singh were named. So far as Narodaya Singh and Malkhan Singh are concerned, they filed Application U/S 482 No.17014 of 2018 in which the complainant and Narodaya Singh have compromised the matter and prosecution against them has been quashed by order date 16.5.2018. After quashing the prosecution against the coaccused nothing remains to be proceeded by the police in the case as the role of firing has been assigned to Narodaya Singh.

The matter requires consideration.

Till the next date of listing no coercive action shall be taken against the applicant in pursuance of charge sheet no.2 of 2017 dated 21.5.2018 registered as Case No.1147/IX/2018 (State vs. Vijay Singh), arising out of Case Crime No.122 of 2017, under Sections 307, 504, 506, IPC and 30 Arms Act, P.S. Marka, district Banda, pending in the court of A.C.J.M- I, Banda.
