Supplementary affidavit filed on behalf of applicants is taken on record.

Heard learned counsel for applicants who pray for quashing of charge sheet dated 20.08.2017 submitted in Case Crime No. 352/2017 registered as Case No. 2650/17 - State Vs. Mohd. Akram and others under Sections 147, 149, 436, 336, 323, 504, 506, 324 I.P.C., P.S. Colonelganj, district Gonda.

Learned counsel for applicants submits that prior to the First Information Report lodged by opposite party no.2, applicant no. 1l has lodged a First Information Report against opposite party no.2. The learned counsel further submits that the dispute between the parties regarding ownership of possession of Gata No. 476/1 a Civil Suit for cancellation of sale deed filed by the applicants is pending before the Civil Court. In order to bring undue pressure on applicant the present case has been lodged.

In view of the above, issue notice to opposite party no.2.

Let counter affidavit be filed within three weeks. Rejoinder affidavit may be filed within one week thereafter.

List on 15.12.2017.

Till the next date of listing, no coercive action shall be taken against the applicants in Case Crime No. 352/17 under Sections 147, 149, 436, 336, 323, 504, 506, 324 I.P.C., P.S. Colonelganj, district Gonda pending before Chief Judicial Magistrate, Gonda.
