Heard Sri Abhijit Saxena for the applicant who submits that the delay of 44 days has been explained and keeping in view the affidavit filed in support of the delay condonation application, the same be accepted and the application be allowed.

We have heard Sri Abhijit Saxena for the applicant.

Notices were issued to first respondent but no one has turned up to oppose this application on behalf of the first respondent even though Sri R.O.V.S. Chauhan learned counsel has put in appearance on behalf of the said respondent.

Having perused the contents of the affidavit filed in support of the delay condonation application, we are satisfied that the cause has been sufficiently explained. The delay deserves to be condoned. The application is allowed. The office shall give a number to this application.

The office is directed to treat the appeal within time and allot a regular number.
