We have heard Shri S.K. Kesarwani, learned counsel for the petitioner, learned Standing Counsel for the respondent no.3 and Ms. Archana Singh, learned counsel for the Bank.
Learned Standing Counsel has placed instruction before us and as per the instruction the order under Section 14 of the SARFAESI Act, 2002 has already been passed by the Chief Metropolitan Magistrate, Kanpur Nagar on 12.04.2016. The bank is required to deposit the amount for taking the aide of police as per the provision of SARFAESI Act, 2002 for the purpose of getting possession of the sold secured assets, which has not been done till date.
The Bank may deposit the expenses for police within a period of one week from today and thereafter the order of the Chief Metropolitan Magistrate, Kanpur Nagar shall be executed in accordance with law within a period of one month thereafter.
The writ petition is accordingly disposed of.
