This is an application seeking modification of the order dated 2.5.2016 by which the writ petition was disposed of by this Court by directing the second respondent to take decision in regard to the claim of the petitioner for compassionate appointment within a period of three months from the date of communication of the order.

In the application it is stated that in the order passed by this Court it wrongly came to be mentioned that the petitioner had passed the efficiency test though in fact he had failed in the test. It is stated that on account of inadvertent mistake at the time of filing of the writ petition, correct facts could not be stated in the writ petition resulting in passing of an incorrect order.

Since the petitioner admits that he had not disclosed the correct facts in the writ petition, therefore, this Court is of the opinion that the order dated 2.5.2016 deserves to be recalled and it is accordingly recalled.

Order on the writ petition

Since it is admitted to the petitioner that the full and complete facts have not been disclosed in the writ petition and that certain wrong facts were mentioned therein, therefore, the writ petition is dismissed on this ground alone.
