Heard learned counsel for the applicants, learned  A.G.A. for the State and perused the record.

Learned counsel for the applicants submits that the applicant no. 2 has lodged a first information report under sections 147, 148, 149, 307 and 504 I.P.C. against the opp. party no. 2 and four others on 29.7.2014. In that case charge sheet was submitted.  An F.I.R. was also lodged by the wife of applicant no. 7 on 10.4.2015 against the opp. party no. 2 and his family members. In counterblast only to make pressure on the applicants, this false and frivolous complaint has been filed on behalf of opp. party no. 2. In fact, no such incident has taken place.

Learned  A.G.A. has accepted notice on behalf of State.

Issue notice to the opp. party no. 2 who may file counter affidavit within three weeks. Rejoinder affidavit may be filed within a week thereafter.

List thereafter on 8.9.2017.

Till the next date of listing, no coercive action shall be taken against the applicants in S.S.T. No. 19 of 2017, arising out of complaint case no. 63 of 2015, under section 395 I.P.C. police Station Naya Gaon District Etah pending in the court of learned Special Judge (D.A.A.) Etah.
