Sri P.K.Srivastava, Advocate, has filed his Vakalatnama on behalf of respondent no.4 today in Court, which is taken on record.

Heard Sri N.S.Chandel, learned counsel for the petitioner, Sri P.K. Srivastava, learned counsel for respondent no.4, Sri R.K. Dwivedi, learned AGA for the State.

This petition has been filed by the petitioner with a prayer to quash the FIR dated 23.6.2017 registered as Case Crime No.595 of 2017, under Sections 498A, 354, 307, 323 I.P.C. and 3/4 D.P. Act, Police station Ghatampur, District Kanpur Nagar.

Learned AGA as well as learned counsel for respondent no.4 have raised a preliminary objection and submitted that the impugned FIR has been registered at District Kanpur Nagar, hence, the present petition is not maintainable before this Court, as territorial jurisdiction lies at main seat of this Court, i.e., Allahababd High Court, hence the petitioners should have filed the present petition at Allahabad, to which learned counsel for the petitioners could not give suitable reply.

Accordingly, the present petition is dismissed on this ground alone with liberty to file fresh before the Allahabad Bench of this Court.

Office is directed to return the certified copy of the order to learned counsel for the petitioners after retaining a photocopy of the same on record.
