Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
This application under Section 482 has been filed by the applicants with the prayer to allow the applicant and quash the charge-sheet dated 6.6.2015 submitted in Case Crime No.63 of 2015, under Sections 147, 149, 323, 504, 427 of I.P.C. and 3 (1) 10 SC/ST Act and cognizance dated 2.7.2015, Police Station Mirzamurad, District Varanasi.
The only prayer made by the learned counsel for the applicants is that for expeditious disposal of bail, a direction may be issued.
In the facts and circumstances of the case, it is directed that in case the applicants appear and surrender before the court below within 30 days from today and apply for bail, their prayer for bail shall be considered and decided in view of the settled law laid by this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgement passed by Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.
Till then, no coercive action shall be taken against the applicants.
However, in case, the applicants do not appear before the Court below within the aforesaid period, protection granted will stand vacated automatically.
With the aforesaid directions, this application is finally disposed of.
