This is the petition filed by the widow of a deceased employee who died during the service. It is submitted that death-cum-other dues are not being paid to the petitioner.
Sri Qamrul Hasan Siddiqui, learned counsel appearing for the respondents submits that pursuant to death of the husband of the petitioner an appointment has been given to his son under the provisions of Dying-in-Harness Rules, but certain amounts was due against the husband of petitioner and therefore, the final dues are not being cleared, to be paid to the petitioner.
That being the case a formal decision has to be taken for payment of dues etc. to the petitioner and if something is due to the department an order to that effect must be passed and informed to the petitioner, otherwise the admitted amount ought to have been paid to the petitioner.
In my view, it would be appropriate to direct the petitioner to file a fresh representation before the respondent no.3 who will consider the claim of the petitioner and pass an appropriate order as for as possible within three months from the date a certificate copy of this order is produced before it alongwith a fresh representation.
With the aforesaid observation, the writ petition is disposed of.
