It is stated that no offence is disclosed on the basis of averments made in the first information report, inasmuch as the allegations, even if, are taken to be correct, at best constitute civil wrong. It is stated that even otherwise, the dispute is amongst the office bearers of society and the office bearers of the committee of management of institution, and filing of chargesheet in the matter is an abuse of process of law. Reliance has been placed upon an order passed by this Court on 4.10.2016 in the matter under Article 227 No.8054 of 2016.
Matter requires consideration.
Learned AGA appearing for opposite party No.1, as well as Shri Rajesh Kumar Kanaujiya, holding brief of Shri Shailesh Shrivastava, learned counsel for opposite party no.2 may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.

Till the next date of listing, no coercive steps shall be taken against the applicants in case No.598 of 2016 arising out of Case Crime No.803 of 2014 under Sections 419, 420, 467, 468, 471 and 120-B IPC, P.S. Medical, District-Meerut pending in the Court of Additional Chief Judicial Magistrate, Court No.5, Meerut.
