Heard learned counsel for the parties.

Application no 81012 of 2016 was filed by respondent side under order 41 Rule 27 CPC for admitting certain documentary evidences. Objection/ Counter affidavit was called on this application but no objection or counter affidavit was filed. Counsel for the appellant informs that department had not communicated  anything against said evidence or regarding filing of objection..

Learned counsel for the respondent states that for meeting the arguments raised in second appeal by appellant side, these documents are necessary. Considering the arguments of respondent and non objection of appellants, this application  no. 81012 of 2016 is allowed. Appellant side may file  documentary evidence in rebuttal, if any within three weeks.
