Heard learned counsel for the applicant as well as the learned AGA.
The present application u/s 482 Cr.P.C. has been filed with the prayer to set-aside the impugned order dated 2.4.2016 passed by learned Additional District Judge, Room No.3, Agra, thereby Criminal Revision No.192/2015 (Dinesh Chandra Vs. State of U.P. and others) of the applicant has been dismissed which was preferred against the order dated 18.6.2015 passed by learned Additional Chief Judicial Magistrate, Court No.8, Agra, rejecting the application moved by applicant under Section 172 (2) Cr.P.C. in Case Crime No.95/2014, under Sections 323/504/506/498A IPC and 3/4 of D.P. Act, P.S. Mahila Thana Rakabganj, District - Agra. Further prayer has been made to stay further proceedings of the aforesaid case.
Matter requires consideration.
Learned AGA has accepted notice on behalf of the opposite party no.1.
Issue notice to opposite party no. 2.
Steps be taken by Registered-Post A/D within a week.
All the opposite parties may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List on 4.8.2016 before the appropriate Bench.
Till the next date of listing, further proceedings of the aforesaid case shall remain stayed only qua the applicant.
