It is contended on behalf of the petitioner that against 98 posts, 720 appointments have been made.
Learned counsel for the District Basic Education Officer was granted time to seek instruction. He has received the instruction but he is not satisfied with the instruction. He seeks further time to get a better instruction.
The petitioners have made a prima-facie case that the appointment of the persons whose names contained in the list, is illegal.
District Basic Education Officer despite several times granted, he has not sent the complete instruction.
Learned Standing Counsel has accepted notice on behalf of respondent nos. 1 and 2 while Sri B.P. Singh has accepted notice on behalf of respondent nos. 3 and 4.
Issue notice to respondent nos. 5 to 16 returnable within six weeks. Notice will indicate that the respondents may file counter affidavit within six weeks from the date of receipt of the notice.
Steps be taken within ten days.
List this case on 16.05.2016.
In view of the said fact, till the next date of listing, the District Basic Education Officer is directed not to draw his salary without leave of the court.
